 | | Transfer Based on Convenience |
The court, on timely motion of any party, may transfer the proceeding to a proper court in any other county in Texas for the convenience of the parties and witnesses and in the interest of justice.
A discretionary transfer for the convenience of the parties may not override a mandatory transfer requirement, however.
Intra-county transfer for convenience.
One court of appeals has held that the statute authorizing inter-county transfers based on convenience also applies to intra-county transfers.
