| | Right to File Original Suit Affecting Parent-Child Relationship |
A grandparent of a child may file an original suit requesting managing conservatorship if there is satisfactory proof made to the court that either:
- The order sought is necessary because the child's present environment presents a serious question concerning the child's physical health or welfare
- Both parents, the surviving parent, or the managing conservator or custodian either filed the petition or consented to the suit.
Immediacy of harm.
One court has construed Family Code Section 102.004(a)(1) as requiring that the child be in imminent danger of physical or emotional harm, and that immediate action is necessary for the child's protection.
