I am not receiving my child support payments.
There are federal laws that permit the interception of tax refunds to enforce child support orders. Other methods of enforcement include:
  • wage attachments
  • property seizure
  • business or occupational license suspension of a non-custodial parent who is behind on child support or
  • in some states like Texas driver's license revocation (suspension).
An attorney or your states Title IV-D agency may employ any one of these methods in an attempt to help you collect from the non-custodial parent. If the non-custodial parent has moved out of state, legal procedures can be used to locate them and seek payment.

If all else fails, the court that issued the child support order can hold the non-custodial parent in contempt and, in the absence of a reasonable explanation for the delinquency, impose a jail term.

This contempt power is exercised sparingly in most states. The reason for this is that most judges would rather keep the non-custodial parent out of jail where they have a chance of earning the income necessary to pay the support.
