 | | Change of Custody |
A change in custody constitutes a material and substantial change in circumstances justifying modification of support. A request for modification of support need not be made at the time custody is changed.
Voluntary relinquishment of possession as alternative ground for modification.
If the sole managing conservator or the joint managing conservator who designates the child's primary residence has voluntarily relinquished the actual care, control, and possession of the child for at least six months, the court may modify a child support order to provide that the person having physical possession of the child has the right to receive support payments for the child and to hold or disburse money for the child's benefit
